Commission’s new digital package on regulations on artificial intelligence, cybersecurity and data

At its core, the package creates a digital omnibus to unify and streamline EU rules on artificial intelligence, cybersecurity and data. This is paired with a Data Union Strategy to enable access to high-quality data for AI development, and with European Business Wallets, which will give firms a single digital identity to simplify procedures and facilitate business across the EU.

These measures aim to ease compliance, potentially reducing administrative costs by up to EUR 5 billion by 2029. The digital omnibus legislative proposals will now be submitted to the European Parliament and the Council for adoption.

DSA: General Court dismisses Amazon’s action challenging Commission’s designation of Amazon Store as very large online platform

The General Court of the European Union dismissed the action, holding that although the Digital Services Act imposes burdens on the freedom to conduct a business, these obligations are lawful, proportionate, and justified by the need to address systemic risks from very large online platforms.

The Court also found no violation of the right to property, as the rules create administrative duties without depriving platforms of ownership and remain justified by the goal of preventing societal risks. Finally, it ruled that the distinction based on having over 45 million users is neither arbitrary nor inappropriate, since such platforms can expose large audiences to illegal content.

The Council gives its approval to new EU rules on suspending visa-free access for third-country nationals

The Council has given final approval to the updated EU regulation for suspending visa-free travel for nationals of third countries who currently enter the Schengen area without a visa. When the new amendments enter into force, the EU will be able to revoke a country’s visa-free status if this third country lacks alignment with EU’s visa policy. The regulation will enter into force on the twentieth day after its publication in the EU’s Official Journal.

ECtHR: Poland breached Article 8 of the ECHR in A.R. v. Poland over restricted access to abortion

The European Court of Human Rights delivered its judgment in A.R. v. Poland, finding that Poland had violated Article 8 of the European Convention on Human Rights. The case concerned the situation of the applicant, who was pregnant when the Polish Constitutional Court ruled on 22 October 2020 that the provision allowing abortion in cases of foetal abnormalities was unconstitutional. Although that ruling did not take effect until its publication on 27 January 2021, the interval between its delivery and publication created substantial uncertainty about the continued availability of lawful abortion, and the applicant was 15 weeks pregnant when the decision was issued.
