Commission sends Statement of Grounds to Temu over possible obstruction of FSR inspection

The European Commission sent a Statement of Grounds to PDD Holdings and its subsidiary WhaleCo Technology, the operator of Temu in the EU, concerning the companies’ alleged failure to actively cooperate with an unannounced inspection carried out in Ireland between 2 and 5 December 2025 under the Foreign Subsidies Regulation (FSR). The Commission preliminarily considers that Temu failed to comply with several requests for information and documents concerning the organisation and management of its EU activities, its IT systems and specific business records, thereby potentially obstructing the Commission’s investigation.

Commission starts enforcing AI Act rules and new transparency requirements on 2 August

From 2 August 2026, the European Commission’s AI Office, together with national authorities, begins enforcing certain provisions of the Artificial Intelligence Act, including rules applicable to providers of general-purpose AI models, prohibited AI practices and transparency obligations. From the same date, certain AI systems must inform users when they are interacting with AI, while AI-generated or altered content, including deepfakes, must be labelled and carry machine-readable markings.

The AI Office will enforce the rules for general-purpose AI model providers, while national competent authorities will be responsible for other AI systems and the European Data Protection Supervisor, for AI systems used by EU institutions. The new framework also introduces practical enforcement tools, including complaint and whistleblower channels. The application of certain high-risk AI rules has been postponed by the AI Omnibus to 2 December 2027 and 2 August 2028, while new prohibitions concerning non-consensual sexually explicit content and child sexual abuse material will apply from 2 December 2026.
