WHEN COMPLIANCE FAILURES BECOME CRIMINAL CASES
A criminal investigation is one of the most serious risks a company can ever face. Even without a conviction, it can disrupt the business, damage its reputation and expose management to personal liability.
Drawing on practical examples from across the Baltics, we will provide company leaders and compliance teams with practical guidance on preventing compliance failures from escalating into criminal cases. We will highlight common weaknesses in risk assessments and controls, including vague risk descriptions, unclear ownership and outdated risk registers, and explain how an effective compliance system can protect both the company and its management.
The session will also provide a brief overview of management board members’ criminal liability under Latvian law and practical guidance on demonstrating that the board has fulfilled its duty of care.

INTERNAL INVESTIGATIONS
Drawing on observations from conducting neutral reviews at clients’ request, we will discuss what motivates companies to commission an independent, outside look at their own business, and the practical scope such reviews typically cover – from financial irregularities and conflicts of interest to breaches of internal policy. We will share our experience of how clients tend to react when findings are reported honestly and without excuses, what distinguishes a review that leads to real organisational change from one that does not, and the practical steps that help a company turn the results of an internal investigation into a stronger compliance framework going forward.

RESPONDING TO MISCONDUCT: HOW EARLY FACT-FINDING PROTECTED THE BUSINESS
A case study walking through a real example of how we helped a client identify the facts and take control of the narrative before a criminal investigation was launched, including how the client structured the initial fact-finding, which internal and external stakeholders were involved, and the key decisions taken in the early days after the first signs of possible misconduct emerged. We will explain how that early, well-documented work later benefited the client during the investigation itself, from establishing credibility with the authorities to narrowing the scope of the proceedings and supporting a more favourable outcome.
