We represented Gintarinė vaistinė and Limedika in a major antitrust case—the largest in Lithuania’s history.

These pharmaceutical companies were fined over EUR 25 million by the Lithuanian Competition Council (LCC) for allegedly coordinating with competitors while lobbying. The LCC claimed they submitted data to the Ministry of Health that influenced the Ministry’s decision to approve new regulated mark-ups.

The court overturned the LCC’s decision, ruling the claims were baseless and stating that joint lobbying by competitors does not amount to forming a cartel. This case sets an important precedent for business associations. The original fines were the highest ever imposed by the LCC.

The ruling may still be appealed to a higher court.
