Sorainen represented the European Commission jointly with members of the Commission’s legal service in proceedings before the Court of Justice of the European Union in Luxembourg under a preliminary reference (TFEU article 267). The case concerned a reference by an Estonian appeal court as to proper interpretation of the rules for fees on official controls verifying compliance with feed and food law, animal health and animal welfare rules.

The Court of Justice judgment, given in July 2011, followed a line of Commission statements prepared by Sorainen jointly with members of the Commission. The court accepted that Estonia was entitled to apply minimum rates under regulation 882/2004 and need not adopt cost based fees.
