The International Swaps and Derivatives Association (ISDA) instructed Sorainen to provide country legal opinions on the enforceability and protection of financial collateral arrangements under Lithuanian law using ISDA documentation.

Our team prepared two distinct legal opinions – one concerning the position of the collateral provider and the other of the collateral taker – both serving as key instruments for enhancing legal certainty and safeguarding transactions involving financial collateral in international capital markets. The possibility of relying on such legal opinions creates more trust in the Lithuanian jurisdiction among foreign banks and other international financial institutions.

The legal opinion was prepared by partners Tomas Kontautas and Augustas Klezys, counsel Dr Lina Aleknaitė-van der Molen and associate Andrius Pilitauskas.

Its members include leading global institutions involved in privately negotiated derivatives transactions, as well as corporations and government entities.
