We successfully represented the Baltic region’s leading commercial real estate management company during proceedings to annul an arbitral award.
At the end of 2025, after an extensive dispute over rent indexation before the Court of Arbitration of the Estonian Chamber of Commerce and Industry, Tallinn Circuit Court confirmed the validity of the arbitral award and resolved the case in its entirety in favour of our client.
The circuit court’s decision is noteworthy because it addresses several important principles of arbitration proceedings that Estonian courts had not previously addressed.
For example, the circuit court interpreted for the first time the limits of the principle of iura novit arbiter for arbitration courts resolving disputes under Estonian law. Additionally, the circuit court explained how the principles of European public policy should be applied in arbitration proceedings conducted in Estonia.
The court’s conclusions confirm that Estonia offers a reliable arbitration environment that adheres to internationally recognised principles.
Our services and client team
This is a significant achievement for the entire Sorainen Baltic arbitration team. Our arbitration team worked in coordination across all three Baltic countries, advising the client on both developing and implementing an arbitration strategy, as well as defending the successful arbitration award before Tallinn Circuit Court.
Our client team included partner Maria Pihlak, senior associate Raul Kartsep, and associates Katariina Kuum and Polina Tšernjak.
