We advised a client on a proposed amendment to the Forest Act that would have increased statutory fines by more than a hundredfold. We analysed the constitutionality of the draft legislation and submitted recommendations to bring it into line with the Constitution.
As a result of our work, the unconstitutional increase in fine levels was successfully prevented — an outcome that, in a worst‑case scenario, could have led to the closure of small and medium‑sized forestry businesses.
