We successfully represented highly respected attorney-at-law Küllike Namm in a precedent-setting criminal dispute in which the attorney was accused of organising fraud amounting to EUR 634,416.75 via civil proceedings and using forged documents. All three court levels fully acquitted the defendants, finding the prosecution’s allegations unproven and legally flawed.

Clarifying questions of confidentiality and the boundaries between civil and criminal proceedings

The case is significant in determining the competencies of criminal and civil courts and in defining the limits of a lawyer’s professional activity. It is a landmark dispute, as the question of whether legal arguments presented during civil proceedings can lead to a wrong court decision and thus criminal liability has not previously been thoroughly addressed in Estonian case law.

On 8 June 2026, the Supreme Court also issued an important ruling in this case, regarding the protection of confidential communications. The Court found that the practice of investigative authorities and the Prosecutor’s Office of requesting e-mails without a court order is unlawful.
